Regulations on use of www.ifmpl.com
I. General information
1. www.ifmpl.com (hereinafter referred to as the Website) is an Internet website owned by Investment Fund Managers Sp. z o.o., with registered office in Warsaw, at Aleje Ujazdowskie 41, entered in the District Court for the City of Warsaw, 19th Commercial and Registry Department, under number 185637. The firm’s share capital has been fully paid up and amounts to PLN 1,375,000. The firm has tax identification number (NIP) 526-27-50-36.
2. Any person who starts using the Website, thus acknowledges and accepts the terms and conditions of these Regulations.
3. The Website is an Internet website containing information on investment funds. The information and material presented in the Website partially derive from third parties and partially from institutions co-operating with Investment Fund Managers Sp. z o.o.
4. Investment Fund Managers Sp. z o.o. reserves the right to change, withdraw, suspend or cease any function or feature of the Website at any time, without the need to notify the users in advance.
5. These Regulations are not the rules referred to in Article 8 of the Act of 18 July 2002 on E-Services (Journal of Laws No. 144, Item 1204, as amended), and the content of the Website does not represent commercial information referred to in Article 9 of the above Act.
6. Investment Fund Managers Sp. z o.o. operates on the basis of a permit issued on 26 April 2004 by the Financial Supervision Commission.
7. Information on the operations of Investment Fund Managers Sp. z o.o. is provided to mass media pursuant to
Article 4 of the Press Law of 26 January 1984 (Journal of Laws No. 5, Item 24, as amended) exclusively upon sending an inquiry to the following e-mail address: ifm@ifmpl.com, with specification of personal details of the person and editor requesting the information.
1. Any person using the Website is understood as a user.
2. The user uses any and all information available in the Website at its sole risk.
3. The use of the Website is subject to limitations and restrictions set in the Polish law and in generally applied standards pertaining to all Internet users, aimed at protection of their interests as well as interests of third parties.
4. The user is solely liable for the use of information included in the Website and for decisions made based on such information.
5. The user undertakes to redress any and all loses and damages which arise as a result of his/her wilful acts or omissions and to satisfy any and all claims of third parties, including those pursued before a court, addressed against Investment Fund Managers Sp. z o.o. and connected with the user’s behaviour that is inconsistent with these Regulations, or with any other negative behaviour.
III. Liability of Investment Fund Managers Sp. z o.o.
1. Investment Fund Managers Sp. z o.o. would like to note that the data and information included in the Website and in websites to which the Website refers the user (links) do not consist, within the meaning of the provisions of law, any offer of services, including investment services, provided to the users of the Website, clients and partners of Investment Fund Managers Sp. z o.o. and they are presented exclusively for information purposes.
2. Investment Fund Managers Sp. z o.o. is not liable for the content of any websites linked to this Website. Any connection with other websites outside this Website is made exclusively at the sole risk of the user. Investment Fund Managers Sp. z o.o. does not provide any warranty, express or implied, as to the accuracy, validity, legality or other features of any materials and information presented in third party’s websites.
3. Investment Fund Managers Sp. z o.o. is not liable for any damage resulting from relying on the presented data, including, in particular, reports, calculations, analyses, information or product regulations. The risk connected with the use of the Website is borne solely by the user.

In case Investment Fund Managers sp. z o.o. receives grounded information that the Website contains information and material that breaches the law or justified personal interests of third parties, Investment Fund Managers Sp. z o.o. will undertake necessary steps aimed at restoring the condition compliant with the law, rules of social co-existence and good practices. The above steps will be undertaken provided that the aforementioned circumstances are made probable to a significant extent or a final and unappealable court decision is issued.

8. Investment Fund Managers Sp. z o.o. reserves the right to refrain from providing any information, advice or reply to any question asked via electronic mail addressed to Investment Fund Managers Sp. z o.o., including, in particular, replies to employment inquiries sent this way.

Investment Fund Managers Sp. z o.o. would like to note that this Website is not intended for entering into financial service agreements at distance, within the meaning of the Act of 2 March 2000 on Protection of Certain Rights of Consumers and on Liability for Damage Caused by a Hazardous Product (Journal of Laws No. 22, Item 271, as amended). In addition, the Website is not intended for provision of e-services within the meaning of the Act on E-Services of 18 July 2002 (Journal of Laws No. 144, Item 1204, as amended).
10. Investment Fund Managers Sp. z o.o. does not assume or bear liability for any damage or infections of the software or any other property of the user, which may result from access to the Website, its using or reviewing its content or downloading any material therefrom.
11. Investment Fund Managers Sp. z o.o. is not liable for a damage resulting from any events which are beyond control of Investment Fund Managers Sp. z o.o.

Investment Fund Managers Sp. z o.o. reserves that the sole document including full and official information on investment funds is a prospectus of an investment fund available, against no payment, in websites of investment fund associations and in customer service centres of entities acting as agents in purchasing and selling the participation units.
14. Investment Fund Managers Sp. z o.o. would like to note that the results achieved by investment funds in the past, as presented in the Website, do not guarantee their achievement in the future.
15. The information presented in the Website is not aimed at substituting the advice of experts. Any use of the presented information without its verification or further advice is made at the sole account and risk of the user.
IV. Partners of Investment Fund Managers Sp. z o.o.
1. Investment Fund Managers Sp. z o.o. is not liable for the content of information included in the websites of its co-operating partners. By using a link, the user is transferred to a website owned by another person.
2. Investment Fund Managers Sp. z o.o. is not liable for privacy policy and policy of protection of personal data by its partners. In order to obtain more information on privacy policy applicable at the partners, one should visit the partner’s website and review its privacy policy in detail.
3. Investment Fund Managers Sp. z o.o. does not control and is not liable for any content included in its partners’ websites.
V. Technical comments
1. Due to technical restrictions Investment Fund Managers Sp. z o.o. cannot guarantee that information sent via the Internet will reach the user in an error-free, complete and accurate form. Investment Fund Managers Sp. z o.o. is not able to guarantee that the Website may be reviewed with no intervals, without technical defects and that the user will obtain precise information which he/she looked for.
2. Subject to applicable provisions of law and these Regulations, Investment Fund Managers Sp. z o.o. is not liable for any damage caused by defective functioning of the transmission system, including hardware failures, delays and defects in information transmission.
3. Investment Fund Managers Sp. z o.o. will use its best endeavours to ensure that any Internet transmission be safe, i.e., that the sent information be transmitted in secrecy, full and complete. However, Investment Fund Managers Sp. z o.o. does not guarantee that such transmission will be safe.
4. Investment Fund Managers Sp. z o.o. does not guarantee security of information sent to the firm. Any such transmissions are performed at the sole risk of the sender.
1. Both the layout of the Website and its component parts, such as written materials, photos, graphics and other materials, enjoy general protection under the copyrights law. Users are obliged to observe and abide by the copyrights law.

5. In case of a damage resulting from the user’s breach of any of the above rules, the user will be obliged to redress the damage on general terms.
VII. Protection of personal data
1. Any information having the nature of personal data within the meaning of the Act of 29 August 1997 on Protection of Personal Data (Journal of Laws of 2002, No. 101, Item 926, as amended) furnished to Investment Fund Managers Sp. z o.o. remains the property of the sender, provided, however, that its sending to Investment Fund Managers Sp. z o.o. via this Website is tantamount to expressing consent for Investment Fund Managers Sp. z o.o. to process the personal data. The recording of personal data in the personal data file of Investment Fund Managers Sp. z o.o. as well as its processing is possible exclusively upon expression of the consent by the person concerned. The consent is expressed by “clicking” the proper field in the website as an equivalent of signature set under the clause on consent to processing personal data. In any case, the personal data will be processed in accordance with the Act referred to above.
1. Any disputes connected with application of these Regulations and functioning of the Website will be settled by common courts competent for the registered office of Investment Fund Managers Sp. z o.o.
2. Investment Fund Managers Sp. z o.o. reserves the right to change the content of these Regulations. Any changes will be published in the website of Investment Fund Managers Sp. z o.o. and will enter into force as of the date of their publication.
